Privacy Notice

1. Who we are and what this notice covers

Realism Labs Inc. (dba Dataland) ("Dataland," "we," "us," or "our") builds and operates AI agents for enterprise customer support and other operational work.

This notice describes personal information we process for our own business purposes, including website visits, inquiries, marketing, and relationships with customer, prospect, and partner contacts. For this processing, Dataland acts as a controller or business under applicable privacy law. A separate notice may apply to a particular activity where provided.

Customer content processed on behalf of an enterprise customer is different. The enterprise-services section below explains that processing. Our customer agreements and applicable DPAs and BAAs govern it; this notice does not replace those agreements or expand our rights to customer content. Information is not excluded from this notice merely because it relates to a customer: this notice still covers personal information we process for our own purposes.

2. Information we collect for our business

Information you provide: your name, work email, telephone number, role, employer, business address, communications with us, meeting or demonstration requests, and marketing preferences. Business relationships may also involve account-administration, billing-contact, and transaction information.

Information collected automatically: IP address, approximate location, browser and device information, referring pages, pages visited, visit times, and interactions with our website and communications. Cookies, pixels, and similar technologies may support this collection.

Information from other sources: business-contact and professional information from public sources, such as company websites and professional networks, and from referrals, business partners, and data or marketing providers. We may combine this information with information you provide or that is collected through the website.

3. How we use information

We use this information to respond to inquiries and arrange demonstrations; manage business relationships, accounts, and billing; communicate about our services; send relevant marketing; understand and improve our website and communications; protect our systems and prevent misuse; and meet legal obligations or establish, exercise, or defend legal claims.

Where a legal basis is required, we rely on our legitimate interests in operating and protecting our business and communicating with business contacts, subject to individuals' rights; consent where required, including for applicable tracking or marketing; performance of a contract with an individual or steps requested before entering it; and compliance with legal obligations. You may withdraw consent without affecting the lawfulness of processing before withdrawal.

4. Website cookies and visitor identification

Our website uses cookies and similar technologies for website operation, analytics, and marketing. We use RB2B for business visitor identification. Online data partners or vendors may associate your website activity with other personal information they or others hold about you, including your email address. We or service providers acting on our behalf may use that information to send marketing communications.

You can use the RB2B/Retention advertising opt-out. RB2B also provides an international data-collection opt-out. These are vendor controls; they do not replace your rights to make a request directly to Dataland at [email protected].

Some disclosures to marketing or visitor-identification partners may be considered a "sale" or "sharing" under applicable US state privacy laws, even when no money is exchanged. Where applicable, you may request that we stop those disclosures. This website marketing activity is separate from processing enterprise customer content under a DPA.

You can also control or delete cookies through your browser settings. Blocking cookies may affect some website functionality and may not prevent every form of data collection. You may unsubscribe from marketing emails through their unsubscribe link or contact us. We may still send non-marketing communications about an existing business relationship.

5. Who receives information

We disclose information as needed to providers that help us operate our business, including hosting, communications, scheduling, business administration, analytics, and marketing providers. Visitor-identification partners may process information as described above; not every website recipient is a processor of enterprise customer content.

We may also disclose information to professional advisers; to authorities or other parties where necessary to comply with law, protect rights and safety, prevent abuse, or resolve disputes; in connection with a proposed or completed merger, financing, acquisition, or transfer of business assets; or at your direction.

Third-party websites and services linked from our site have their own privacy practices. Review their notices when you use them.

6. Enterprise AI-agent services and customer content

Dataland's agents work within customer-authorized systems and integrations. Depending on the engagement, they may process customer and end-user contact or account details, support conversations, orders and transactions, operational records, source materials, and other content needed for the assigned work. Some deployments involve health or other sensitive information, subject to the applicable agreement and safeguards.

Task-specific content may be sent to third-party model providers for inference: generating responses, analysis, or actions. Inference is distinct from training or fine-tuning model weights. Agents may perform automated processing or actions within the scope authorized by the customer. The customer's privacy disclosures and applicable law determine any additional notices and rights associated with those activities.

When processing personal information on a customer's behalf, Dataland acts as a processor, subprocessor, or service provider, as applicable, and follows the customer's documented instructions and the governing agreement. That agreement determines permitted data use, customer-specific evaluation or improvement, any permitted model training, security requirements, retention, and deletion or return. This notice does not authorize additional uses or override stricter contractual restrictions.

Our enterprise subprocessor list identifies providers used in delivering the services, including model providers. The applicable DPA governs subprocessor approvals, change notices, and objections. If your information is being processed on behalf of one of our customers, direct a privacy request to that organization first. We assist our customers with requests as required by the applicable agreement and law. If you need help identifying the appropriate contact, email [email protected].

7. Retention and security

For information covered by our own business practices, retention depends on the purpose of collection, the nature and sensitivity of the information, the duration of the business relationship, and legal, accounting, security, and dispute-resolution needs. We retain information for as long as needed for those purposes and then delete or de-identify it, subject to applicable requirements. We may retain limited suppression information to honor marketing opt-outs.

Retention of enterprise customer content is governed by the applicable customer agreement, instructions, and legal requirements, not by a general right to retain it indefinitely for Dataland's own analysis.

We use technical and organizational safeguards designed to protect personal information. No system or transmission method can be guaranteed completely secure.

8. International processing

Dataland is based in the United States. Personal information may be processed in the United States and other locations where relevant providers operate, subject to applicable contractual and legal restrictions. Privacy laws may differ between countries. Where required for a transfer, appropriate safeguards apply, such as relevant standard contractual clauses and the UK transfer addendum. Contact us for information about the safeguards applicable to your information. Enterprise deployment and transfer restrictions remain governed by the applicable customer agreement and DPA.

9. Your privacy rights

Depending on your location and applicable law, you may have rights to know about or access your personal information; obtain a portable copy; correct or delete it; restrict or object to certain processing; withdraw consent; opt out of sale, sharing, or targeted advertising; and exercise rights concerning certain automated decisions. These rights are subject to applicable conditions and exceptions.

Send requests to [email protected]. We may need to verify your identity and an authorized agent's authority before responding. We will respond within the time required by applicable law and will not unlawfully discriminate against you for exercising your rights. Where applicable, you may appeal a decision by contacting us and stating that you are appealing a privacy-request decision, or complain to your relevant data protection authority.

10. Children

Our marketing website is directed to adults. We do not knowingly collect children's personal information through it. If you believe a child has provided such information, contact us. This statement concerns our website, not customer-directed processing in an enterprise deployment.

11. Updates and contact

We may update this notice as our practices change. We will display the update date and provide additional notice or obtain consent where required by law. A notice update does not amend a customer contract or by itself provide consent to new processing. The July 16, 2023 version is available for reference.
